Judicial
campaigns are unlike any others. The elections are non-partisan. Candidates
are not selected by political parties and do not appear on the
ballot as Republicans or Democrats. In order to maintain
a fair and impartial court system, promises by judicial candidates
about political issues or suggestions about how they will rule
on cases are out of place.
People and businesses are entitled to know that their cases
will be decided by judges who are impartial, approach every case
with an open mind, have no outside agenda, and will base their
decisions on the law rather than ideology. Any candidate
who expresses a personal viewpoint on an issue in advance of
having to decide that issue in court becomes a judicial activist
and compromises his or her objectivity.
Voters,
as a result, must make their choices based upon each candidate’s
qualifications and experience, character, and judicial philosophy. By
any of these measures, Justice Carol Hunstein deserves reelection.
Qualifications
and Experience
Carol Hunstein is
one of Georgia’s most qualified and experienced judges
with more than 22 years on the bench. The breadth of
her support among practicing lawyers attests to her impartiality,
wisdom, and independence. She is supported by lawyers
across the legal spectrum – those who have won and
lost cases before her, by prosecutors and criminal defense
attorneys, by personal injury lawyers and insurance defense
lawyers, by solo practitioners and partners in multi-national
law firms, and by lawyers from every corner of our state. Non-lawyers
have recognized her experience and qualifications too. She
is supported by Democrats and Republicans all over Georgia.
Character
It is often said that character
is developed through overcoming adversity. Carol Hunstein has overcome
more than her share – poverty, polio, childhood cancer, loss of her mother
at age 11, amputation of a leg as a young adult, abandonment and divorce. She
embodies the values of discipline, hard work, a strong sense of personal responsibility,
tolerance and toughness. Her story of struggle and triumph is an inspiration
to others.
Judicial Philosophy
Justice
Hunstein is dedicated to a fair and impartial judiciary. Her
judicial philosophy is simple – to honor her oath of office
to uphold the Constitution and laws of the United States and
the State of Georgia. She considers each case which comes
before her based upon the facts as presented in that case and
constrained by the rule of law. As she has written: “It
is the province of the Georgia General Assembly to enact the
laws of Georgia, and a judge should not take any action to make
any law or to express his or her opinion as to the wisdom of
any laws. A judge’s role is to interpret those laws
based upon the Constitution and the legal precedent binding upon
that judge in conjunction with the facts presented in an actual
case or controversy.”
